Honorable Paul A. Engelmayer

U.S. District Court Judge, U.S. District Court for the Southern District of New York

American Freedom Defense Initiative v. Metropolitan Transportation Authority

(excerpts from transcript of hearing on motion for preliminary injunction)

Let me begin by commending counsel.  We’ve spent a lot of time reviewing the briefs and the associated submissions in the case, and I want to say to both of you that the submissions were absolutely terrific.  Really unusually well done and unusually well organized, and made my life a lot easier in trying to reconstruct the events and the relevant documents, so kudos to both of you.  I see a lot of submissions in this job. These were really among the best, so thank you. . . .

We’ll now hear oral argument from counsel.  But before we do, I want to specifically commend, first of all, Mr. Yerushalmi, because I thought that was a very useful examination for me. . . .

What I said at the beginning I’ll say at the end.  I want to thank you for the exceptionally high quality of advocacy.  Thank you.

Honorable Emmet G. Sullivan

U.S. District Court Judge, U.S. District Court for the District of Columbia

Priests for Life v. U.S. Department of Health & Human Services

(excerpt from transcript of hearing on cross-motions for summary judgment)

The Court agreed to resolve this case before the end of 2013 and will certainly do so.  I’m going to keep this hearing brief.  I’ve read everything.  And let me just compliment the parties.  You’ve done an excellent job of thoroughly briefing the issues and responding to the Court’s supplemental orders for additional briefing, and believe me, I really appreciate that.  The parties were thorough, they were timely in their submissions, and it makes our job a lot easier.  So thanks to all, regardless of the outcome.  Thank you to plaintiffs; thanks to defense counsel.
